1. Agreement and scope
These Terms of Service (“Terms”) govern use of the SimHub App and SimHub online activities offered through it — including accounts, memberships (when synced), league registrations and operations, and future simulator bookings when launched — by SimHub Race Lounge Inc. (“SimHub”, “we”, “us”).
Winter League is one regulated activity under these Terms; it is also subject to published Winter League rules, Prize Terms v1.2.0, and any approved participation waiver/release.
By creating an App account or using SimHub App features, you agree to these Terms and the [Privacy Policy v1.7](/privacy), plus activity-specific rules incorporated by reference (e.g. Winter League rules and prize terms — not all App use is league participation).

2. Eligibility and accounts
- You must provide accurate information and keep it updated.
- You are responsible for safeguarding your password and all activity under your account.
- Notify us promptly at info@simhubracelounge.com if you suspect unauthorized access.
- We may refuse, suspend, or terminate accounts for fraud, abuse, or violation of these Terms or league rules.

3. Memberships and renewals (Shopify; App sync planned)
Website (in force today): Memberships (e.g. Basic $50/year) are sold via Shopify. Renewals are automatic; payments are final and non-refundable once processed; members may cancel future renewals by contacting info@simhubracelounge.com before the next renewal — see subscription policy and refund policy.
SimHub App: Membership status sync is planned (Simplee/Shopify integration). Until App sync launches, website policies control membership purchases. App Terms will be updated when in-app membership management ships.

4. Simulator bookings
Self-serve simulator booking checkout is not yet available in the SimHub App (/book is a coming-soon boundary). When booking launches, these Terms will be updated for cancellation windows, no-show policy, and payments.

5. Winter League participation
Participation in Winter League 2026 (and similar events) is subject to:
- Published Winter League rules (version accepted at registration)
- Championship Prize Terms v1.2.0 (incorporated by reference)
- Official iRacing terms and sporting rules in session (SimHub does not replace iRacing)
- Platform: iRacing; car: Radical SR10 (unless a new rules version says otherwise)
- Schedule: America/Toronto — Tuesday race night (practice 7:30–8:30 PM, qualifying 8:30–8:45 PM, 20-minute race at 8:45 PM — no separate sprint race)
- Overall capacity and Lounge entry capacity are enforced in software
- Stewarding: Official iRacing sporting rules apply; SimHub Race Lounge has final SimHub authority over league penalties, protests, and disqualifications, subject to iRacing platform rules
- No driver-to-driver entry transfers without written SimHub authorization
- Disconnects: An individual driver disconnect does not trigger a race restart; widespread iRacing server failure may lead to a restart authorized by SimHub Race Lounge
- Conduct: No intentional wrecking, harassment, cheating, or result manipulation

6. Registration, pricing, and payments
- Entry fees are shown at checkout with Ontario HST (13%) on the advertised base price.
- Home: base C$250.00 → C$282.50 total
- SimHub Lounge: base C$500.00 → C$565.00 total
- Checkout may hold a 15-minute reservation while payment completes.
- Registration is confirmed only after successful payment and required steps (including verified email where enforced).
- Payments are processed by Square. You authorize charges for the displayed total.
- No refunds: Registration fees are non-refundable except where required by applicable law or explicitly authorized in writing by SimHub management. This is disclosed before payment.

7. Refunds, cancellations, and chargebacks
Winter League (App / Square):
- Participant-initiated cancellation does not entitle you to a refund unless required by applicable consumer protection law or written SimHub authorization.
- The App may allow you to submit a refund request for staff review; submission does not guarantee approval (see refund policy).
Store products (website): Standard products, custom/turn-key sims, and memberships follow website refund and subscription policies — not this section.
Chargebacks: Website policies ask customers to contact SimHub first. We may suspend App accounts and league participation for abusive chargebacks.

8. Age eligibility and parent/guardian consent
- In-lounge simulators (website policies): Under 18 requires parent/guardian accept and sign before use (see Terms of Service and participation waiver requirements on simhubracelounge.com).
- Online Winter League: No separate SimHub minimum age beyond iRacing eligibility; under 18 requires electronic guardian consent at App registration (no minor self-attestation).
- Prizes: Age-specific experiences (Prize Terms v1.2.0).

9. Conduct and disqualification
You must not:
- Violate law or third-party rights
- Attempt unauthorized access to systems, data, or admin functions
- Interfere with other users or the integrity of events
- Misrepresent identity, iRacing account, or eligibility
League-specific conduct and penalties are in Winter League rules. SimHub may disqualify participants from sessions or the series for serious or repeated violations.

10. Assumption of risk, liability, and disclaimers
Sim racing (online and in-person) involves competitive and technical risks, including equipment failure, internet outages, and contact incidents governed by iRacing or venue rules.
Services are provided “as is” and “as available” to the extent permitted by law.

11. Intellectual property
- iRacing trademarks and game content belong to their owners.
- User-submitted content (e.g. display names) may be used to operate the league (standings, announcements) as necessary to run events.

12. Competition disputes, protests, and prizes
- SimHub Race Lounge has final SimHub authority on league penalties and disqualifications, subject to iRacing platform rules.

13. Third-party services
Your use of iRacing, Discord, Square, email providers, and other linked services is subject to their terms. SimHub is not responsible for third-party outages (including widespread iRacing server failures), except as required by law.

14. Privacy
Our [Privacy Policy v1.7](/privacy) describes how we handle personal information. By using the app, you acknowledge that policy.

15. Governing law and disputes
Website Terms (published): Governed by the Province of Ontario and the laws of Canada (website ToS §18).

16. Changes
We may update these Terms. Material changes will be communicated as required by law and through the app. Continued use after the effective date may constitute acceptance where permitted.
